Agreement to Terms

By accessing or using Flowmetric Automation's website (flowmetricautomation.com) and AI receptionist services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

Flowmetric Automation ("we," "our," or "us"), operated by Ayman Mohammed provides AI Automation and Website services to clients.

Description of Services

Flowmetric Automation provides:

• AI-powered phone answering and call handling
• Automated appointment booking and scheduling
• Call routing and transfer services
• Customer inquiry management
• SMS and email notifications
• Analytics and reporting dashboards
• Integration with third-party calendar and CRM systems

Our AI receptionist uses artificial intelligence to answer calls, respond to customer inquiries, and perform administrative tasks on behalf of your business.

Eligibility

You must be:

• At least 18 years of age
• Authorized to represent a business or organization
• Capable of entering into a binding contract

By using our Services, you represent and warrant that you meet these eligibility requirements.

Account Registration

Creating an Account

To use our Services, you must provide accurate and complete registration information, maintain and update your account information, keep your login credentials secure and confidential, and notify us immediately of any unauthorized access.

Account Responsibility

You are responsible for all activity that occurs under your account, maintaining the confidentiality of your account credentials, any content or data transmitted through your account, and compliance with these Terms by anyone using your account.

Subscription and Billing

Payment Terms

• Subscriptions are billed monthly or annually in advance
• Payment is due upon subscription or renewal
• We accept credit cards, debit cards, and other payment methods as specified
• All fees are non-refundable except as required by law

Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.

Acceptable Use Policy

You may use our Services only for lawful business purposes and in compliance with these Terms.

Prohibited Activities

You may NOT:

• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any systems or networks
• Use the Services to spam, phish, or send unsolicited communications
• Reverse engineer, decompile, or attempt to extract source code
• Violate any applicable telemarketing or consumer protection laws
• Make calls to numbers on Do Not Call registries without proper consent
• Record calls without proper consent where required by law

Call Recording and Data Usage

Call Recording

Our AI receptionist may record calls for quality assurance and training purposes, providing transcription services, improving AI accuracy and performance, and compliance and dispute resolution.

You are responsible for ensuring compliance with call recording laws in your jurisdiction, including providing notice and obtaining consent where required.

Intellectual Property Rights

All content, features, and functionality of our Services, including AI technology and algorithms, software and source code, website design and content, trademarks and logos, and documentation and materials, are owned by Flowmetric Automation and protected by copyright, trademark, patent, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for your business purposes in accordance with these Terms.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.

We do not guarantee that the Services will meet your specific requirements, the AI will respond accurately to all inquiries, calls will always be answered or routed correctly, or the Services will be available 24/7 without interruption.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWMETRIC AUTOMATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, COST OF SUBSTITUTE SERVICES, OR REPUTATION DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Termination

Termination by You

You may terminate your account at any time by canceling your subscription through account settings or by contacting customer support at [email protected].

Termination by Us

We may suspend or terminate your access to Services immediately, without notice, if you violate these Terms, engage in fraudulent or illegal activity, fail to pay fees when due, or use the Services in a manner that harms us or other users.

Effect of Termination

Upon termination, your right to use the Services ceases immediately, we may delete your account and data after 30 days, and you remain responsible for all fees incurred before termination.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions, class arbitrations, or representative actions.

Changes to These Terms

We may modify these Terms at any time by posting updated Terms on our website. Continued use of the Services after modifications constitutes acceptance of the updated Terms.
